These Terms and Conditions set out the terms governing the Win a Trip to Iceland Prize Draw. The promoter of the Prize Draw is Avalis Glacier Water Ltd. Please read these Terms and Conditions carefully and ensure that you understand them before submitting your entry for the Prize Draw.
Avalis Glacier Water Ltd. is a limited company registered in England and Wales under company number 13980725. Our registered address is 12 Greenway Farm, Bath Road, Wick, Bristol UK and Our main trading address is Unit 8, Mill Batch Farm, East Brent, Highbridge, TA9 4JN.
By submitting an entry to the Prize Draw, you are agreeing to accept and be bound by these Terms and Conditions. If you have any questions, please contact Us at enquiries@avalisglacierwater.com. Please note that We reserve the right to refuse entry or refuse to award a prize to anyone who is in breach of these Terms and Conditions.
1. Definitions and Interpretation
1.1 In these Terms and Conditions, unless the context otherwise requires, the following expressions have the following meanings:
“Closing Date” means the closing date of the Prize Draw, as set out in Clause 3;
“Draw Date” means the date on which the winner will be chosen, as set out in Clause 5;
“Opening Date” means the opening date of the Prize Draw, as set out in Clause 3;
“Prize Draw” means the Win a Trip to Iceland prize draw, further details of which are shown in Clause 5;
“We / Us / Our” means Avalis Glacier Water Ltd. whose details are provided above; and
“You / Your” refers to the person entering the Prize Draw, subject to these Terms and Conditions.
2. Prize Draw Entry Rules
2.1 The Prize Draw is open to all UK residents aged 18 and above, subject to the exceptions shown in Clause 2.2. By submitting an entry, you warrant and represent to Us that You meet this eligibility criteria and You agree to provide such evidence of eligibility as We may reasonably require.
2.2 The following may not enter the Prize Draw:
a) Our employees or their families; and/or
b) Our agents, subcontractors, and any other third parties involved in or directly associated with the running of the Prize Draw.
2.3 Only one entry per person is permitted. Multiple entries shall be disregarded and may result in disqualification from the Prize Draw.
2.4 Entries must be submitted by a person on their own behalf only. Entries made on behalf of others will not be permitted.
3. Opening and Closing Date
3.1 The Opening Date of the Prize Draw is 09.00 GMT on 12th September 2023.
3.2 The Closing Date of the Prize Draw is 23.59 GMT on 2nd October 2023.
3.3 Entries received after the Closing Date will not be valid, accepted, or considered.
3.4 We reserve the right to cancel, suspend, amend, or hold void the Prize Draw where it becomes necessary to do so.
4. How to Enter the Prize Draw
4.1 Prize Draw entries are free. No purchase is necessary. However, you are responsible for any costs of accessing and using the services required for submission of your entry, such as any internet service and/or mobile data charges.
4.2 To submit your entry to the Prize Draw:
a) Follow us on Facebook @AvalisGlacierWater or Instagram @avaliswater
b) ‘Like’ the giveaway post on the Avalis Glacier Water @Avalis Water Instagram or Facebook @AvalisGlacierWater
c) Comment on the post
and these requirements must be met and verifiable as at both the Closing Date and Draw Date in order for your entry to be considered.
4.3 Please note that We do not accept any responsibility for any entries which are not successfully completed (e.g. lost or delayed) due to technical faults (including, but not limited to, hardware, software, and network faults) or for entries which We do not receive.
4.4 Entry for this Prize Draw is not accepted by any other means, such as email, telephone or post. Any such entries will be disregarded.
5. The Prize Draw
5.1 A winner will be selected by random draw, which shall be performed by a computer process within 7 days of the Closing Date
5.2 The Prizes will be as follows:
a) A trip to Iceland for two (2) adults which includes return economy class (or equivalent) flights from a UK airport plus 1 item of checked baggage per traveller, 3 nights’ accommodation in Reykjavik (Standard Double or Twin room on a bed and breakfast basis at the Exeter Hotel, Reykjavik) and 2 Premium admission tickets to the Blue Lagoon, Iceland. Transfers to and from the airport in the UK and Reykjavik (including airport parking) are not included. Transfers from the hotel in Reykjavik to the Blue Lagoon are not included. No optional flight/boarding/transfer/accommodation supplements are included in the prize. Travel insurance is not included. Winners are advised to take out their own insurance; and
b) 2 cases of Avalis Glacier Water 500ml Tetra Pak (12 packs per case).
5.3 The winner will be notified within 5 days after the Draw Date and must respond with a postal address (in order to claim their product prize), their preferred contact details, preferred dates for travel and also information on their preferred departure airport.
5.4 If a winner does not respond to Us within 5 days of being notified, their prize will be forfeited, and We shall be entitled to select another winner using the process set out above.
5.5 The prize must be booked by 14th November 2023 and the trip must be completed by 31st March 2024. Flight bookings will be made directly by the winner, using a flight discount code/voucher provided by Us once the departure airport is established. Once booked, We shall not be responsible should the winner be unable or unwilling to proceed with any aspect of the trip and no refund or replacement shall be provided by Us.
5.6 The trip to Iceland must be completed, and therefore the prize winner must be available to travel within one of the following dates ranges:
5.6.1 30/10/2023 to 10/12/2023 or
5.6.2 06/01/2024 to 10/02/2024 or
5.6.3 20/02/2024 to 31/03/2024,
and the prize is subject to flight, hotel and attraction availability within these date ranges.
5.7 Avalis Glacier Water will liaise directly with the competition winner to finalise flight, accommodation, and Blue Lagoon arrangements.
5.8 The winner will receive their cases of Avalis Water by postal delivery, typically within 7 days of their response.
5.9 If You are the winner, you acknowledge and agree that your name and image may be published by Us and you may be required to participate in publicity activities.
5.10 The winner must ensure that they and their guest hold passports that are valid for travel on the selected dates and that they and their guest are not subject to any restriction which may impact their ability to travel.
5.11 Prizes are non-exchangeable and non-transferrable. No cash alternative is offered.
5.12 We reserve the right to substitute a prize with an alternative prize of equal or greater value in the event that circumstances beyond Our control make it necessary for Us to do so.
5.13 In addition to the exclusions specified in Clause 5.1, the prizes exclude any other additional costs and expenses that may apply in relation to the redemption and use of the prizes, and the winner is solely responsible for all applicable taxes, costs and expenses payable in respect of the prizes.
5.14 Our decision regarding any aspect of the Prize Draw is binding and final. We will not enter into any correspondence about the decision.
5.15 We are required to publish or otherwise make available information which indicates that a valid award has taken place. The surname and county of major prize winners (and, where applicable, copies of winning entries) are available from Us by:
a) Writing to Us at Avalis Trip to Iceland Competition, Unit 8, Mill Batch Farm, East Brent, Highbridge, TA9 4JN, enclosing a self-addressed envelope; or
b) Sending an email to Us at enquiries@avalisglacierwater.com;
within 30 days after the Closing Date.
5.16 If you object to any of your information, as set out above in sub-Clause 5.11, being published or otherwise made available, please contact Us by post at Unit 8, Mill Batch Farm, East Brent, Highbridge, TA9 4JN or by email at enquiries@avalisglacierwater.com. Please note that We are still required to provide such information and winning entries to the Advertising Standards Authority on their request.
6. Limitation of Liability
6.1 Nothing in these Terms and Conditions limits or excludes your legal rights as a consumer. For more information on your rights as a consumer, please contact your local Trading Standards Office or Citizens Advice Bureau.
6.2 Nothing in these Terms and Conditions limits or excludes Our liability (or that of Our agents or distributors, or that of their employees) for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other form of liability that cannot be excluded or limited by law.
6.3 To the extent permitted by law, and subject to sub-Clauses 6.1 and 6.2, We (and Our agents and distributors) shall not be responsible or liable to compensate any winner and shall not accept any liability for any loss, damage, death, or personal injury, as a result of accepting and/or using a prize.
7. Privacy and Personal Data
We will only use your personal information as set out in Our Privacy Policy, available from www.avalisglacierwater.com and as explained above in Clauses 5.11 and 5.12.
8. Law and Jurisdiction
8.1 These Terms and Conditions, the Prize Draw, and the relationship between Us and you (whether contractual or otherwise) shall be governed by, and construed in accordance with, English law.
8.2 Any dispute, controversy, proceedings, or claim between Us and you relating to these Terms and Conditions, the Prize Draw, or to the relationship between Us and you (whether contractual or otherwise) shall be subject to the jurisdiction of the courts of England, Wales, or Scotland, as determined by your residency.
